1. Digital Products & Licensing
All Showit templates, Canva templates, digital files, and related materials (“Digital Products”) are protected by copyright and licensed—not sold—to you for personal or business use.
Unless otherwise stated, your purchase grants you a single, non-transferable license to use the Digital Product for your own business.

You may not:
Resell, share, redistribute, or give away Digital Products
Claim the design or content as your own
Use the Digital Product to create templates for resale
Provide access to subcontractors or designers for reuse
Remove copyright or proprietary notices
We may revoke your license if these terms are violated.

2. Template Customization Services
If you book template customization or related services, you agree to:
Provide timely materials and approvals
Communicate promptly
Pay all required invoices
Final deliverables will not be transferred to your Showit account or released until full payment is received.

3. AI Use Restriction (Prohibited Uses)
You may not use any of our Digital Products, designs, images, layouts, graphics, copy, photography, or any other content from the Site—including content posted on Instagram or Pinterest—for the purpose of training, fine-tuning, or improving artificial intelligence or machine learning models.
This includes, but is not limited to:
Uploading our content into AI tools or generators
Using our templates or designs as prompts for AI-generated works
Allowing contractors or third parties to process our content through AI tools
Scraping or extracting our content for datasets
Using AI to create derivative or lookalike designs intended for resale, redistribution, or template creation
Any AI-related use of our Digital Products or content is strictly prohibited and constitutes a violation of these Terms and our intellectual property rights.

4. No Refunds on Digital Products
Because digital products are delivered instantly, all digital sales are final.
No refunds, exchanges, or cancellations are offered once a product is purchased.
Refunds for services (if applicable) are governed by your individual project agreement.

5. Pricing & Payment
Payments are securely processed through Shopify.
We do not store credit card information.
Prices may change at any time without notice.

6. Intellectual Property
All content, templates, designs, graphics, photos, copy, and digital products on the Site—including our Instagram and Pinterest content—is owned by Pinkerton Photography LLC, DBA Pinkerton House and protected by copyright laws.
You may not:
Copy, replicate, or redistribute our content
Claim our templates, images, or layouts as your own
Use our content to train AI or machine learning models
Create derivative works for resale or distribution
Remove proprietary notices
Unauthorized use constitutes infringement.

7. User Conduct
By using the Site, including our social media channels, you agree not to:
Misuse or interfere with the Site’s functionality
Attempt unauthorized access
Upload harmful or malicious content
Harass or abuse others on our platforms
We reserve the right to block or remove users who violate these guidelines.

8. Disclaimers
The Site and all Digital Products and Services are provided “as is” without warranties of any kind, express or implied. We do not guarantee:
Increased traffic, bookings, or revenue
Specific outcomes from using our templates or services
Uninterrupted or error-free performance
Your results depend on your images, copy, SEO efforts, and implementation.

9. Limitation of Liability
To the fullest extent allowed by law, we are not liable for:
Lost profits
Business interruption
Loss of data
Errors, delays, or performance issues
Damages arising from the use (or inability to use) our Digital Products or Services
Your exclusive remedy is to stop using the Site.

10. Third-Party Tools & Links
We use third-party platforms such as Shopify, Showit, Google Analytics, Flodesk, and others. We may also embed or link to external platforms such as Loom, Pinterest, Instagram, or YouTube.
These platforms have their own terms and privacy practices, and we are not responsible for their content or actions.

11. Governing Law
These Terms are governed by the laws of the State of Arizona, without regard to conflict of law principles.
